GENERAL TERMS AND CONDITIONS
Contract Concluded at a Distance
The contract pertains to products available for purchase in the ZAX Hungária Kft. online store.
Product attributes, characteristics, and purchase prices can be viewed by clicking on the respective product's subpage.
Upon sending the order and its confirmation via ZAX Hungária Kft.'s email, a contract is established between the consumer and the enterprise, with ZAX Hungária Kft. acting as the Service Provider and the Orderer as the Buyer, based on Government Decree 45/2014.(II.26).
The Supplier is obligated to deliver the product chosen by the Buyer to the provided delivery address via post or courier. Alternatively, the Buyer may opt for personal collection.
If any obstacle arises in fulfilling the order, the Supplier must promptly contact the Buyer via email or phone to coordinate next steps.
The Buyer is obligated to accept the products specified on the order form, delivered to the provided address, and pay the purchase price indicated on the Supplier's confirmation in cash upon delivery, if they selected the cash-on-delivery payment method.
Right of Withdrawal
The Buyer has the right to withdraw from the contract without justification within 5 working days.
The consumer's right of withdrawal can be exercised:
- For the product itself, in the case of a product sales contract,
- For the last delivered product, if multiple products are sold and delivered at different times.
The consumer's right of withdrawal can be exercised through a clear statement to that effect.
The deadline for withdrawal is considered met if the Buyer sends their statement before the deadline expires.
If the Buyer withdraws from the distance contract, the Supplier must refund all payments made by the consumer, including delivery costs, without undue delay and within 14 working days from being informed of the withdrawal.
The Supplier will use the same payment method for the refund as the one used by the consumer, unless the consumer agrees to a different method. The Buyer will not incur any fees as a result of the refund. However, if the Buyer chose a delivery method other than the cheapest standard delivery offered by the Supplier, the Supplier is not required to refund the additional costs.
The Supplier may withhold the refund until they have received the returned product or until the Buyer provides evidence of having sent back the product, whichever comes first.
If the Buyer withdraws from the distance contract, they must send back or hand over the product to the Supplier without undue delay and in any event not later than 5 working days from the day on which they communicate their withdrawal. The direct cost of returning the product shall be borne by the Buyer.
Exceptions to the Right of Withdrawal
The Buyer cannot exercise the right of withdrawal in the case of:
- A service contract after the service has been fully performed, if the performance began with the consumer's prior express consent and acknowledgment.
- A product or service whose price or fee is dependent on fluctuations in the financial market which cannot be controlled by the Supplier.
- A product made to the consumer's specifications or clearly personalized.
- Goods which are liable to deteriorate or expire rapidly.
- Sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
- Goods which are, after delivery, according to their nature, inseparably mixed with other items.
- Any product that the Supplier assembled specifically following the Buyer's instructions or on an individual order.
- If the Buyer has opened the nylon packaging of the pre-prepared chocolate by the Supplier, considering the nature of the product, it cannot be reused or resold, and thus the Buyer cannot exercise their right of withdrawal.
The Buyer is responsible for the cost of returning the package. Upon the package's arrival at the Supplier's location, the unboxing and inspection of the returned product will be recorded on video. If the purchased product is returned in its entirety and undamaged, and it wasn't assembled based on the Buyer's individual order, the Supplier will refund the purchase price to the Buyer within 14 days following the withdrawal.
Handling Consumer Complaints
If the Buyer has any complaints or issues during the purchase, they should report them via email to firstname.lastname@example.org. All complaints will be investigated, and a response will be provided within 5 days. In justified cases, the product will be replaced. If the issue isn't resolved through this channel, the Buyer can turn to the aforementioned supervisory bodies.
Product and Warranty
Warranty for Goods
Under our contract, both parties have mutual obligations, and the obligated party is responsible for any defects in performance.
Based on their warranty claim, the entitled party can request:
- Repair or replacement, unless the chosen warranty right is impossible to fulfill.
- A proportionate reduction of the consideration if the other party does not agree to repair or replacement.
Withdrawal from the contract due to a minor defect is not possible.
Repair or replacement must be completed within an appropriate timeframe, considering the entitled party's interests.
The court is not bound by the entitled party's request but cannot order the fulfillment of a warranty right that both parties object to.
A defect reported within 2 days of its discovery is considered to be reported without delay.
The entitled party is liable for any damage resulting from a delay in reporting.
The Buyer's warranty claim expires two years from the date of completion. The obligated party bears the costs associated with fulfilling the warranty obligation.
In the case of a defect in a movable item (product) sold by a business to a consumer, the consumer may claim a product warranty against the manufacturer. A product is defective if it does not meet the quality requirements in force at the time of placing on the market or if it does not have the features described by the manufacturer.
The manufacturer is exempt from product warranty only if they can prove that:
- The product was not manufactured or distributed in the course of their business.
- The defect was not recognizable given the state of scientific and technical knowledge at the time the product was placed on the market.
In the case of replacement, the manufacturer is responsible for the warranty of the replaced product or the repaired part of the product.
The consumer must communicate the defect to the manufacturer without delay after its discovery. A defect communicated within two days of its discovery is considered to be communicated without delay. The consumer is liable for any damage resulting from a delay in communication.
When asserting warranty claims, the provisions of Act V of 2013 on the Civil Code and Decree 19/2014. (IV.29.) NGM are applicable.
Browsing the ZAXCHOCO Online Store
You can browse the ZAXCHOCO website without registration, familiarizing yourself with our unique products and prices. The prices listed next to the products are gross prices, inclusive of VAT, and are in Hungarian forints. However, purchasing is only possible after registration. Our online store does not display stock, but only those raw materials are listed on the website that are in stock. We confirm all orders within 48 hours of placing the order.
Regarding stock, you can also inquire by phone through our customer service. After placing an order, the chocolate production begins as soon as possible, but within a maximum of 3 working days, and the duration is one day. From the time of order, the delivery of the chocolates is expected within a maximum of 2-4 working days.
If you have any complaints during your purchase, please report them via email to email@example.com. We will investigate all complaints and provide a response within 5 days. In justified cases, the product will be replaced. If the issue isn't resolved through this channel, you can turn to the aforementioned supervisory bodies.
